Nonhazardous Solid Waste Impoundment Guidance


The next meeting is tentatively scheduled for November 6, 2019.


DEQ invites the public to participate in the development of guidance pertaining to the regulation of pumpable waste received at nonhazardous solid waste impoundments under the Solid Waste Management Rules (IDAPA 58.01.06). The guidance will apply to facilities commercially receiving solid waste from off-site where: (1) the waste does not pass the paint filter test prior to placement in an impoundment unit, and (2) operations are not otherwise regulated under a discharge or land application permit.

Facilities engaged in food processing or other manufacturing or industrial activities with on-site treatment of liquid waste are not affected by this guidance initiative. Those facilities generally do not receive off-site waste and are often regulated through discharge permits or land application permits.

Stakeholders may include: Owners and operators of existing or proposed impoundment facilities commercially accepting liquid or pumpable waste, owners and operators of approved landfills with impoundment facilities inside and outside their certified areas commercially accepting liquid waste, pumpable waste haulers and generators, local governments addressing issues related to these facilities, and the affected public.

Meeting Schedule

At the next scheduled meeting identified below, Stakeholders will have the opportunity to comment on Draft 4 of the NSWI guidance document. This is intended to be a complete draft for final consideration by stakeholders. If possible, DEQ intends to finalize the draft and present it at the March 2020 meeting of the Idaho Solid Waste Association.
